Churches are subject to special rules when they buy, sell or mortgage real property. These rules may be found in a specific governing statute such as The United Church of Canada Act, in denominational policies or the Religious Organizations’ Lands Act. Charities and non-profits may be subject to restrictions in their letters patent and by-laws that must be complied with. Other considerations such as GST exemptions specific to charities may also apply. It is advisable to use the services of a lawyer experienced in acting for churches, charities and non-profit organizations to handle your real estate transactions as many lawyers are not familiar with the applicable legal considerations. I have many years of experience in carrying out real estate transactions for these types of organizations with particular expertise in acting for churches and regional bodies of The United Church of Canada.
